The Nature of Probate is the classification of the Probate case that you are filing. Refer to the Nature of Probate section form more details.

 

 

When filing a Probate case, select Probate from the Nature of Probate dropdown list.  Then, select the Type of Probate from the dropdown list.

Choices can either be Double Probate or Probate.

 

 

 

 

The details of the deceased are needed to be entered when a probate case is filed. Refer to the Deceased Details section of the online guide for more details.

 

 

Limitations of the Grant are the boundaries or restrictions of the grant being claimed. These limitations can be indicated in the Probate case file. Refer to the Limitations to the Grant section for more details.

 

 

Applicant Capacity information should be entered when filing a Probate case. Refer to the Applicant's Capacity section for more information.

 

 

 

A Certification is a proof of when the probate case has been created for Back End users to link to different caveat, probate, WOS, or OS cases. Refer to the Certification section of the online help for more details.

 

 

 

 

 

When the status of the executor, other than the applicant is Renounced, the user will be asked to enter the Name and the Date of Renunciation/Death of the executor.

Applicant's Capacity

 

The Probate Statement can either be composed by the Law Firm User.  It can also be downloaded and then filled out by the actual applicant, and then later on, uploaded in the system.

 

Once the Step 1: Case Information Page has been filled out, the Step 2: Form Page will be displayed with a list of the required eForms or documents needed to continue the filing.

The deceased's will and other documents related to the probate case can be uploaded to the eLitigation system. Refer to the Adding Documents topic for more details.

 

 

 

Once the Probate case file has been submitted, it will be saved in the eLitigation system. The user can view the different documents saved or attached to the Probate case.
