Admiralty Writ of Summons

Before a warrant of arrest can be issued, the applicant must apply for a warrant of arrest, and procure a search to be made in the record of caveats.  This is ensure is there is any caveat against the arrest in force, with respect to property involved.

In addition, the applicant has to provide a letter to the Registry, which states the particulars of the person who is authorised to effect the arrest (i.e., the applicant’s nominated agent) pursuant to Section 65A of the Supreme Court of Judicature Act.

A written undertaking has to be provided to the Sheriff to indemnify, and provide the Sheriff with sufficient funds to meet the charges and expenses incurred in consequence of the request for arrest.
